Why Debt Laws Vary by State

The state you live in significantly affects your rights, your risks, and your options when dealing with debt.

Statute of Limitations

Ranges from 3 years (Louisiana, Maryland, NY) to 10 years (Rhode Island, West Virginia). After the SOL expires, creditors cannot successfully sue you to collect.

Wage Garnishment Rules

Four states (TX, PA, NC, SC) don't allow wage garnishment for consumer debt. Others range from 10% (NJ) to 25% of disposable income. Your state determines your risk.

Asset Protections

Homestead exemptions range from $0 (some states) to unlimited (TX, FL, KS, OK). Understanding your state's protections affects which debt relief strategy makes the most sense.

Consumer Protections

Many states have their own debt collection laws that go beyond the federal FDCPA, providing additional protections against harassment, deceptive practices, and unfair collection methods.
